Loopstra Nixon LLP acted on behalf of the Town of Innisfil in support of the proposed Big Bay Point Resort on the shores of Lake Simcoe. The approval process, including the almost-four month Ontario Municipal Board hearing, spanned several years. The environment-first Big Bay Point Resort is expected to bring the Town recreation opportunities and open space, cultural amenities, a golf course, a marina, employment and other fiscal benefits.

Court Decision:
Charles Loopstra and Mike McWilliams were winning counsel when the court dismissed a multi-million dollar action against their client, a leading store fixture manufacturer.In Rogers & Rogers v. Pinehurst Woodworking Co., [2005] O.J. No. 5297, the Superior Court of Justice held that a restrictive covenant was unenforceable and illegal as a restraint of trade and also commercially unreasonable.The court also held that there was no breach of any fiduciary duty.
