Charles M. Loopstra, Q.C. receives praise for his chapter in 10th Anniversary edition of the Annual Review of Civil Litigation

Carswell has just published the 10th Anniversary edition of Annual Review of Civil Litigation which is regularly cited by appellate courts across Canada, including the Supreme Court of Canada.  The book includes a chapter written by C.M. Loopstra, Q.C. of this firm, and assisted by associate lawyer Andy C. Jairam on Developments in the Law of Negligent Misrepresentation.  In a foreword written by Chief Justice McLachlin of the Supreme Court of Canada she refers to the chapter as “promoting a common understanding of recent legal developments” .  Justices Archibald and Echlin of the Superior Court of Ontario in an Overview write:  The author has done an excellent job of outlining the considerations involved in determining the duty of care, proximity, the standard of care, reliance, causation, and damages.  Mr. Loopstra has also provided a detailed review of the available defences to negligent misrepresentation, including the failure to satisfy the essential elements, disclaimers, contributory negligence, remoteness and a failure to mitigate…This article is a “must read” for those interested in the incremental changes that have expanded negligent misrepresentation in Canada.
