Loopstra Nixon Successful in Enforcing International Arbitral Award and Defeating Application to Set Aside

Loopstra Nixon acted for SI CHUAN HENG WAN KE JI YOU XIAN GONG SI, d.b.a. Zillnk, in an application to enforce Zillnk’s international arbitral award (the “Award”), and to defeat the corresponding cross-application to set aside the Award.

In a decision dated July 16, 2026 (available here), Justice Black of the Commercial List held that Zillnk was entitled to recognize and enforce the Award and dismissed the cross-application to set aside. In doing so, Justice Black analyzed issues of procedural fairness, jurisdiction, and public policy, before holding that there was no basis to set aside the Award.

Zillnk was ultimately able to recognize and enforce its award of CAD $6,113,706 and USD $9,667,163, along with the right to recover future profits from the improper use of Zillnk's IP and costs of the arbitration in excess of USD $2 million.
