Loopstra Nixon Successfully Defends $3 Million Contractor Claim in ODACC Adjudication
Loopstra Nixon lawyers, Christopher Lee, Christophe Shammas and Raj Johal, recently acted for a successful municipal owner in the dismissal of an ODACC adjudication involving a contractor claim exceeding $3 million.
The claim arose from a dispute relating to entitlement to profit from the descoping of certain works from a CCDC contract. The adjudicator dismissed the claim in its entirety and ordered the claimant to reimburse our client for its share of the adjudicator's fees. The decision serves as an important reminder that, even in the expedited adjudication process, significant claims must be supported by contemporaneous records and credible substantiation. Adjudication may move quickly, but this does not lessen the claimant’s burden to prove its claim.
